Terms and Conditions

1. Services

Ark Care Partners provides in-home aged care under Home Care Packages (HCP) and disability supports under the NDIS, including daily living assistance, personal care, community access, and supported accommodation (SIL-type supports). We do not provide CHSP-funded services.

2. Service Agreements

All services are delivered under a written Service Agreement that outlines the scope of supports, schedule, fees, and responsibilities of both parties.

3. Participant & Client Rights

You have the right to be treated with dignity and respect, receive safe and high-quality care, make informed choices, and raise concerns or complaints without fear of retaliation.

4. Fees and Payments

NDIS services are charged in line with current pricing arrangements, while HCP services follow agreed provider pricing. Payment terms will be clearly outlined in your Service Agreement.

5. Bookings and Cancellations

Services must be scheduled in advance. We require at least 24 hours’ notice for cancellations. Short-notice cancellations may incur charges in accordance with applicable funding rules.

6. Participant Responsibilities

You agree to provide accurate information, maintain a safe environment for staff, treat workers with respect, and communicate any changes to your needs or schedule.

7. Provider Responsibilities

We are committed to delivering services in line with applicable standards, employing qualified staff, maintaining confidentiality, and ensuring safe and reliable care.

8. Incidents and Complaints

All incidents and complaints are taken seriously and managed in line with regulatory requirements. You may raise concerns directly with us at any time.

9. Limitation of Liability

To the extent permitted by law, Ark Care Partners is not liable for events beyond our reasonable control or for indirect or consequential losses.

10. Suspension or Termination

Services may be suspended or terminated if safety concerns arise, terms are breached, or payments are not maintained. You may also end services as outlined in your agreement.

11. Governing Law

These Terms and Conditions are governed by the laws of Australia.
